Terms of service
On this page
These terms are the agreement between you and Puffin Studios, Inc., a Delaware corporation based in California, which makes Puffin. In these terms, "we" means Puffin Studios, Inc. They cover Puffin's website and app and everything you do in them.
Puffin's privacy notice says what Puffin collects, why, who sees it, how long Puffin keeps it, and what you can do about it. Read it with these terms.
You agree to these terms when you choose "Agree and continue". Puffin records the version you agreed to and the time.
Who can use Puffin
Puffin is for people 18 and over. It is not open to people who live in the European Union, Iceland, Liechtenstein, Norway, Switzerland, the United Kingdom, or the state of Washington. When you sign up, Puffin asks your birth month and year and where you live, and it does not create an account for anyone under 18 or anyone who lives where Puffin is not open. The Student module is for university students.
Each person can hold one Puffin account, for their own use.
Your account
Puffin signs you in with Google or with a code it emails you, so keep your Google account and your email account safe. Keep those codes, and any password, authenticator, or recovery codes you have for Puffin, to yourself. Let no one else use your account. If you think someone else has used it, write to team@puffincalendar.com at once.
Puffin uses the email address on your account for every message your account needs. Keep that address current.
What Puffin does
Puffin plans your week around your calendar, your work, and your energy. Puffin's planner places your work in time. Puffin proposes work it finds in a mailbox you connect, and you decide whether to accept each proposal. Puffin adds a travel booking from your mail as an event, and work from a sender whose work you accepted before as a task, each with Undo. Puffin's planner also moves work it placed when your plan changes, with a note and Undo.
Puffin may place a plan wrongly or lose an item. We keep backups, and Puffin should not be your only record of anything that matters.
Puffin may be unavailable at times. We can add, change, or remove features.
Health and wellbeing
Puffin is a planner. It offers no therapy, diagnosis, or medical advice, and it treats no condition.
If you connect a ring, Puffin's planner uses your sleep, readiness, and activity only to plan around them, and Puffin's AI never sees them.
Puffin assistant and other AI features
Puffin assistant, the Student tutor, and the goals conversation are AI. Puffin assistant and the tutor say so at the start of every chat. All three run on AI models from Anthropic. Before what you write to these three features first reaches Anthropic, Puffin asks your permission once. That one yes also covers the other uses the privacy notice names with it, and each use has its own off switch in Settings, under AI and privacy. Turning off Puffin's AI stops every feature that sends your words. The privacy notice names every other way your data reaches Anthropic, such as the records Puffin assistant reads to answer you and the reading of a mailbox you connect.
AI can be wrong. Check a reply before you rely on it for anything that matters.
Puffin assistant applies a change you ask for when the change can be undone, and it offers a one-step undo. It asks you first before a change that cannot be undone or that reaches outside your account. "What Puffin assistant can't do" in the chat's menu lists its limits.
Puffin sets a daily limit on Puffin assistant. The chat warns you when you are close to it and says when it resets.
When you use Puffin's AI features, you must also follow Anthropic's Usage Policy (https://www.anthropic.com/legal/aup).
What Puffin's AI writes for you in your account is yours to use. We claim no right in it beyond what we need to run Puffin for you.
You can report any reply from the place you read it. The report sends us that chat.
Your content
Your content is what you put into Puffin: your events, your work, your goals, your notes, what you write or say to Puffin's AI features, the pictures you send, what you bring from another assistant, and the files you upload. You keep every right you hold in your content.
You give us permission to store, copy, process, and show your content only to run Puffin for you and to do what you ask. That permission covers sending your content to the providers the privacy notice names, for the purposes it names. Puffin trains no model shared with other people on your content.
Your permission ends when you delete the content or your account. It continues for backup copies until they are gone, within 90 days. It also continues for anything else the privacy notice says stays.
Upload, send, and connect only content you have the right to use. A picture of other people's messages or faces is content you share for them, so share it only where they would expect it.
Feedback you send may be used to improve Puffin, without payment or credit.
Services you connect
You can connect Google, Microsoft, and Oura. Each connection asks your consent first. You can remove a connection at any time. The terms of each of those services apply to your use of that service.
We make no promise about Puffin on behalf of Google, Microsoft, or Oura. As far as the law allows, those services give no warranty about Puffin, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and they are not liable to you for indirect, special, consequential, or punitive damages that arise from Puffin.
Rules for using Puffin
You must not:
- use Puffin to break the law.
- reach, or try to reach, another person's account or data.
- use Puffin's AI features in a way Anthropic's Usage Policy forbids.
- get around a limit Puffin sets, such as the daily limit, with automated tools or extra accounts.
- probe or attack Puffin's systems. Send any flaw you find to the security address on Puffin's website.
Puffin's name and brand
The name Puffin, the puffin logo, the drawn "Puffin" wordmark, the P monogram, and Puffin's look are trademarks of Puffin Studios, Inc. You may not use any of them, or anything confusingly similar, without our written permission. That includes using them as the name, logo, or icon of your own product, and any use that suggests we made, approve, or sponsor something we did not.
You may name Puffin in plain words to refer to it, for example to say that your work connects with Puffin or to write about it, as long as you do not suggest that we endorse you.
Payment
Puffin is free. We charge nothing and ask for no payment details.
If Puffin ever costs money, we will tell you first and you will choose.
Ending your account
You can stop using Puffin and delete your account at any time from settings, and you can export your data first. The privacy notice says what deletion removes, when backup copies are gone, and what stays.
We can suspend or close your account if you break these terms seriously or repeatedly, or if the law requires it. Unless the law or someone's safety prevents it, we tell you why first and give you 30 days to export your data.
What we promise about Puffin
We provide Puffin as it is and as it is available. We make no promise that Puffin will be free of errors, that a plan will suit you, or that a reply from Puffin's AI will be right. The promises in these terms and in the privacy notice still bind us.
Limits on our liability
As far as the law allows, we are not liable for lost profits or for indirect, special, or consequential damages. Our total liability to you for all claims about Puffin is limited to the greater of what you paid us in the 12 months before the claim and 100 US dollars.
Nothing in these terms limits a liability the law does not allow us to limit.
Disputes
California law governs these terms.
Before you bring a claim, write to team@puffincalendar.com and tell us what is wrong. We will try to settle it with you within 30 days.
You and we bring any dispute in the state or federal courts in Alameda County, California. Either of us can instead bring a claim that qualifies in small claims court.
The private test
If you joined Puffin during its private test, the tester notice applies to you until you agree to these terms. Puffin keeps working for you in the meantime, and you can agree at any time under "Launch notice" in settings.
Changes to these terms
Puffin keeps every version of these terms with its date. When we change them, Puffin shows you the new version and asks you to agree, and we email you about the change.
A new version applies to you once you agree to it. Until then, the version you agreed to keeps applying, and Puffin takes no feature away from you because you have not agreed.
The rest of the agreement
If a court finds part of these terms unenforceable, the rest of them still applies.
We may pass these terms on to a company that takes over Puffin, and we will tell you when we do. The sections on our liability, on disputes, and on Puffin's name and brand keep applying after your account ends.
